www.stonology.fr (the “Site”) is published and distributed by STONOLOGY, a simplified joint-stock company registered with the Avignon Trade and Companies Register (947 485 231 RCS AVIGNON).
VAT not applicable according to article 293B of the General Tax Code.
The terms of sale are governed exclusively by French law. All products offered are governed by international copyright law.
I. APPLICATION OF THE GENERAL CONDITIONS OF SALE
These general conditions of sale are concluded between:

Any person wishing to make a purchase via the Seller's website, at the address https://www/stonology.fr Hereinafter referred to as "The Customer" or "The Buyer" on the other hand.
1.1 The Customer must read the T&Cs prior to any order (the “Order”), the T&Cs being available on the Site.
1.2 The Customer must be at least 18 years old and have full legal capacity or hold parental authorization allowing him to place an order on the Site.
1.3 STONOLOGY reserves the right to adapt or modify these General Terms and Conditions at any time. The applicable version of the General Terms and Conditions is the one appearing online on the website https://www/stonology.fr at the time of the Order. Consequently, placing an Order requires the Customer's full, express, prior and unreserved acceptance of the General Terms and Conditions of Sale by ticking the box "I have read and accept the general terms and conditions of sale".
1.4 As a reminder, in accordance with the provisions of Articles 1316 to 1316-4 of the Civil Code, supplemented by Decree No. 2001-272 of March 30, 2001, taken for the application of Article 1316-4 of the Civil Code and relating to electronic signatures, STONOLOGY specifies that the validation of the order form as specified in Article 4.3 below, constitutes an electronic signature which has, between the Parties, the same value as a handwritten signature.
1.5 The General Conditions of Sale aim to define the rights and obligations of the Parties arising from the online sale of the Products offered on the Site.
II. INFORMATION ON THE SITE AND REGISTRATION
2.1 The Site https://www/stonology.fr offers for sale a variety of accessories (hereinafter the “Product(s)”) to Internet users browsing the Site (hereinafter the “User(s)”). For the purposes of this Agreement, it is agreed that the User and STONOLOGY will be collectively referred to as the “Parties” and individually referred to as the “Party”, and that the User who has validated an order will then be referred to as the “Buyer”. The rights and obligations of the User necessarily apply to the Buyer.
2.2 To place an Order, the Customer must first register on the Site by creating an account with their name, contact, delivery and billing information. The Customer will then receive a registration confirmation email.
2.3 When creating an account, the Customer must ensure that the data they provide is accurate and complete. The Customer is required to always update their personal information. In the event of an error in the recipient's contact details, STONOLOGY cannot be held responsible for the inability to deliver Products.
III. PRODUCTS
3.1 The Products offered for sale are those listed on the Site on the day the Customer consults the Site, within the limits of available stocks. These details are updated automatically. However, STONOLOGY shall not be liable in the event of cancellation of an Order for a Product due to stock depletion. In the event of a stock shortage, STONOLOGY undertakes to inform the Customer as soon as possible.
3.2 In the event of a breach and if payment has already been made, STONOLOGY undertakes to contact the payment service used by the Customer to deduct the price(s) of the unavailable Product(s) from the amount debited from the Buyer's bank account.
3.3 STONOLOGY describes the characteristics (materials, colors, size, etc.) of its Products on each product sheet with the greatest possible accuracy to best satisfy the Customer's information. However, it is possible that errors may appear on the Site, or that the photographs may not accurately reflect the colors of the stones and other materials, which the Customer acknowledges and accepts. Consequently, STONOLOGY cannot be held responsible and the photographs do not enter into the contractual scope.
3.4 The Products ordered remain the property of STONOLOGY until full payment has been received.
3.5 Personalized jewelry orders are neither refundable nor exchangeable.
IV. ORDERS
4.1 The User must identify himself by completing the form which must include the information necessary for his identification: his first name, last name, email address, password, date of birth, delivery address and billing address.
4.2 The User is informed and accepts that entering his/her identifier constitutes proof of his/her identity and expresses his/her consent.
4.3 Validation of the Order constitutes confirmation of the Customer's acceptance of the General Terms and Conditions, the Products purchased, their price and the associated costs.
4.4 The User will then be invited to pay for their order by entering their bank details.
4.5 When the Buyer confirms payment for their order, a summary is displayed with the transaction number. This summary is also sent by order confirmation email. For this purpose, the Customer formally accepts the use of email.
4.6 A shipping confirmation email is sent to the Buyer on the day the Products are shipped, containing the package tracking link.
4.7 Pursuant to Article L. 134-2 of the Consumer Code, when an order concerns an amount equal to or greater than 120 euros, STONOLOGY keeps the document which records the contract concluded between the Seller and the Buyer electronically for a period running from the conclusion of the contract until the date of delivery of the goods and for a period of ten years from this date (in accordance with Decree 2005-137 of February 16, 2005).
4.8 STONOLOGY shall not be held liable to the Customer for the harmful consequences of the withdrawal of a Product from the Site, or the replacement or modification of any content or information appearing on this Site, or the refusal to process an Order after sending the confirmation email summarizing the Order.
V. PRICE AND PAYMENT TERMS
5.1 Product prices are indicated on the Site in euros. The company is exempt from VAT (VAT not applicable, Article 293B of the French General Tax Code). For any order outside the European Union, customs duties and other taxes must be paid by the Customer directly to the carrier upon delivery. STONOLOGY is not required to check and inform the customer of applicable customs duties and taxes.
5.2 The price charged to the Buyer is the price indicated on the order confirmation sent by email by STONOLOGY. The prices indicated on the site are guaranteed on the day of the order within the limits of available stocks, except in the event of an obvious typing error.
5.3 STONOLOGY reserves the right to modify its prices at any time, without prior notice, depending on economic conditions, the pricing policy of the various suppliers and changes in the prices of materials. The Products will be invoiced on the basis of the prices in effect at the time of registration and payment of the Order, subject to availability.
5.4 The Products are payable in cash upon validation of the Order.
5.5 The data recorded by the Site constitutes proof of transactions between STONOLOGY and the Buyer. The data recorded by the payment system constitutes proof of financial transactions. The sale becomes final after acceptance of the transaction by the secure services.
5.6 The Customer expressly acknowledges that the communication of his/her bank card number to STONOLOGY constitutes authorization to debit his/her Account for the amount of the Products ordered. If applicable, a notification of cancellation of the Order due to non-payment is sent to the Customer by STONOLOGY to the email address provided by the Customer when registering on the Site.
5.7 The prices indicated do not include shipping costs which will be charged in addition and will be specified to the Customer upon final validation of their order.
VI. DELIVERY
6.1 The Products ordered are, at the Buyer's discretion, delivered to any address anywhere in the world. Some countries may be temporarily excluded due to unstable political or health conditions. Deliveries are made to the address indicated by the Customer for this purpose.
6.2 Deliveries are made by uninsured Tracked Letter or Colissimo from La Poste to the customer's home. We also offer deliveries to a relay point via Mondial Relay or ChronoShop2Shop, subject to acceptance of the package by the selected Relay Point. Deliveries are made from Monday to Friday, depending on the option chosen by the Customer when confirming their Order.
6.3 The Delivery costs applicable to the Order are those mentioned on the Site at the time of the Order.
6.4 Delivery times are indicated after the order has been processed and are expressed in working days. These times may be extended due to external events (strikes, export problems, customs changes, etc.) or technical problems that are beyond the control of STONOLOGY and for which we cannot be held responsible.
6.5 The Buyer may check the tracking of his order on the Internet using the tracking number provided.
6.6 Our jewelry is made to order and we do not hold any stock. STONOLOGY will make every effort to ensure that the order is shipped within a maximum of eight (8) working days from the day following the Customer's validation of their order. This period is indicative and may be extended due to a supply problem.
6.7 The information provided by the Buyer when placing the order is binding on the Buyer. In the event of an error in the recipient's contact details, STONOLOGY cannot be held responsible for the impossibility of delivering the Product or for a delay in delivery. The Customer must ensure that they have provided accurate and complete information regarding the Delivery address (such as, in particular: street number, building number, staircase number, access codes, names and/or intercom numbers, etc.).
6.8 The Products ordered by the Buyer will be delivered to the address indicated by the latter on the order form or deposited at the Post Office responsible for the delivery address indicated by the Buyer, in the event of the absence of the recipient of the Products. In the latter case, the postman will leave a calling card in the mailbox of the said recipient allowing them to collect their package during the working hours of the Post Office, within fifteen (15) days.
6.9 In the event that Delivery cannot be made due to an incorrect delivery address or the Customer's failure to collect their Order from the selected collection point or Colissimo, the Customer will be charged the reshipping costs calculated based on the weight and destination. Any reshipment due to an incorrect delivery address or failure to collect from the Postal Services will result in the payment of additional costs. If the Buyer refuses to pay these additional reshipping costs, the order will be cancelled and the price of the order will be refunded to the Buyer's account less the shipping costs incurred.
6.10 The Customer is required to check the condition of the packaging and the Items upon Delivery. It is the Customer's responsibility to make any reservations and complaints he deems necessary, or even to refuse the package, when the package is clearly damaged upon Delivery. Said reservations and complaints must be sent to the carrier by registered letter with acknowledgment of receipt within three working days following the date of Delivery of the Goods. The Customer must also send a copy of this letter to the Seller. Failure to make a complaint within the aforementioned period extinguishes any action against the carrier in accordance with Article L. 133-3 of the French Commercial Code.
6.11 The Customer must ensure that the Goods delivered to him correspond to the Order. In the event of non-conformity of the Goods in nature or quality with the specifications mentioned in the Delivery note, the Customer must inform the Seller by email hello@stonology.fr and return the Goods to the address indicated. A return label will be provided by the Seller.
6.12 The Products offered comply with current French legislation. STONOLOGY cannot be held liable in the event of non-compliance with the legislation of the country where the Products are delivered. It is the Buyer's responsibility to check with local authorities the possibilities of importing or using the Products ordered.
VII. RIGHT OF WITHDRAWAL: RETURNS & REFUNDS
7.1 In accordance with Article L.221-18 of the Consumer Code, the non-professional Customer has a period of fourteen (14) days from receipt of the Order to exercise his right of withdrawal from STONOLOGY, without having to justify his decision.
7.2 The right of withdrawal can be exercised using the withdrawal form obtained by contacting customer service at the following address: hello@stonology.fr . We will send you the return address by email.
7.3 Items must be returned at the customer's expense within 14 working days. Any risk associated with returning the Product is the responsibility of the Buyer. The Seller is not responsible for the loss of the package by the postal services.
7.4 The Buyer will have the option to request an exchange or refund of the Product.
7.5 To exercise his right of withdrawal, the Buyer must make his request within fourteen (14) days following receipt of the Product, in accordance with Article L. 221-21 of the Consumer Code. Beyond this period of fourteen (14) days, the sale is firm and final.
7.6 The Product must be returned to STONOLOGY to the address provided by email ( hello@stonology.fr ) and under the following conditions:
- To be in perfect condition,
- Never having been used,
- Be in its original packaging and complete, unworn and unwashed, so that it can be remarketed in new condition.
The right of withdrawal cannot be exercised if the items have been damaged, deteriorated or soiled by the Buyer.
7.7 In the event that the above-mentioned conditions are met, STONOLOGY will reimburse the Buyer the amounts corresponding to the Product(s) purchased. The reimbursement period is fourteen (14) days from the date on which the Product has been received back by STONOLOGY. STONOLOGY will make the reimbursement using the same means of payment as that used for the payment of the Order. If and only if the latter has expired, STONOLOGY will contact the Customer to make the reimbursement by another means of payment and to the extent that the reimbursement does not incur additional costs for STONOLOGY. If the Customer fails to comply with these General Terms and Conditions, STONOLOGY will not be able to reimburse the Products concerned. The return costs are the responsibility of the customer.
7.8 On the other hand, in accordance with article L.121-20-2, 3° of the Consumer Code, the right of withdrawal, as well as any request for reimbursement, cannot be exercised for Products which are the subject of personalization (specific request concerning the size, color, chain, clasp, medallion, stones of a jewel) at the request of the Customer.
VIII. DATA PROTECTION
8.1 The provision of personal information collected in the context of distance selling is mandatory, as this information is necessary for the processing and delivery of orders and for the preparation of invoices. This information is strictly confidential. Failure to provide this information will automatically result in the order being rejected.
8.2 The security protocol guarantees total confidentiality of the information transmitted. STONOLOGY undertakes not to transmit or use any personal information of its Buyers (Data Protection Act No. 78-17) unless it is strictly related to its activity.
8.3 In accordance with the French Data Protection Act No. 78-017 of 6 January 1978, the User has the right to access, rectify and oppose any communication of personal information concerning him/her. To exercise this right, the User must make a request to STONOLOGY by email at the following address : hello@stonology.fr .
IX. WARRANTIES – LIMITATION OF LIABILITY & FORCE MAJEURE
9.1 The documents, descriptions and information relating to the Products appearing on the Site are not covered by any warranty, express or implied, except for warranties provided by law. STONOLOGY provides no warranty regarding any damage that may be caused by the transmission of a computer virus, or any other form of programming routine designed to damage, destroy or otherwise impair any functionality of a computer or impair the proper functioning of the latter, including any transmission resulting from a download of any content carried out by the Customer, the software used by the Customer to download the content, the Site or the server that provides access to it. In this regard, the Customer acknowledges that it is his responsibility to install appropriate anti-virus and security software on his computer hardware and any other device in order to protect them against any bugs, viruses or other programming routines of this nature that prove harmful.
9.2 STONOLOGY shall not be liable for the total or partial non-performance of its obligations under this contract, if this non-performance is caused by an event constituting force majeure, in particular in the event of disruption or total or partial strike in particular of postal services and means of transport and/or communications, pandemic, flood, fire, and generally, in the event of an event beyond its control.
X. GUARANTEE OF CONFORMITY
10.1 STONOLOGY ensures the perfect quality of its products, and takes every care of them from their manufacture to their sale. However, if a product is not compliant, the Customer benefits from a contractual guarantee for six (6) months following its purchase.
10.2 This warranty applies to normal use. The warranty does not cover failure to follow care instructions that have led to accelerated wear and tear, such as the use of perfume/cosmetics, cleaning products, sea or pool bathing, or prolonged contact with water. Also excluded from the warranty are breakage or loss resulting from an accidental circumstance, natural wear and tear, the intervention of a third party, or improper use.
10.3 Within the framework of this six (6) month warranty, the Product will be replaced or repaired. The return costs for repair/replacement as well as the redelivery costs are the responsibility of the Customer.
10.4 If repair and replacement of the product are impossible, the Customer may return the product and have the price refunded or keep the product and have part of the price refunded, in accordance with the provisions of Article L. 211-10 of the Consumer Code.
XI. INTELLECTUAL PROPERTY
11.1 All elements of the Site, whether visual or audio, are reserved under copyright as well as intellectual and artistic property. This applies worldwide. Any total or partial reproduction of the Site is strictly prohibited without prior agreement. Failure to comply with this obligation constitutes an infringement engaging the civil and criminal liability of its author. Similarly, any process, in particular relating to the technique of framing or deep-linking is formally prohibited, except with express, special and written authorization issued by the Seller.
11.2 The name “STONOLOGY” has been registered as a trademark with the INPI. Consequently, any reproduction of this trademark by the Customer, not authorized by the Seller, constitutes an act of counterfeiting liable to criminal and civil prosecution.
The models, jewelry, accessories, photos, objects and images offered by the site are the property of STONOLOGY and are protected by intellectual property law.
The Customer acknowledges that the use he may make of the products ordered is limited to use in accordance with their intended purpose.
In application of the provisions of the Intellectual Property Code, the legislative and regulatory provisions of all countries and international conventions, any representation and/or reproduction, use, distribution, publication, exploitation by anyone, in whole or in part, of one of the elements mentioned above, made without the prior written consent of STONOLOGY is prohibited and constitutes an infringement which may be subject to criminal and civil sanctions.
11.3 The Customer therefore undertakes not to infringe the “STONOLOGY” trademark in any way. It is strictly prohibited to use or reproduce the name “STONOLOGY”, in any capacity whatsoever, and on any medium whatsoever, without the prior written consent of the Seller.
XII. PARTIAL DISABILITY
If one or more provisions of these T&Cs are held to be invalid or declared as such pursuant to a law, regulation or following a final decision of a competent court, the other provisions shall retain their full force and scope.
12.1 These General Conditions of Sale and the order summary sent to the Buyer form a contractual whole and constitute the entirety of the contractual relations between the Parties.
12.2 In the event of any contradiction between these documents, the General Conditions of Sale shall prevail.
XIII. MEDIATION - APPLICABLE LAW - COMPETENT JURISDICTION
13.1 These General Conditions of Sale and the contractual relations between the Parties are subject to French law.
13.2 In the event of a complaint not resolved amicably by Customer Service, the Customer may contact the dispute resolution platform put online by the European Commission at the following address: http://ec.europa.eu/consumers/odr/ .
13.3 In the absence of an amicable resolution, any dispute relating to the interpretation of the General Terms and Conditions, the execution or termination of a sale, the interpretation, execution or termination of these terms and conditions shall be submitted, in the absence of an amicable agreement, to the legally competent courts.
XIV. WARRANTY, AFTER-SALES SERVICE AND RETURNS
14.1. Guarantee of your jewelry
Jewelry purchased from Stonology benefit from a four (4) month warranty from the date of purchase mentioned on the invoice. This warranty exclusively covers manufacturing defects.
14.2 Procedure in the event of a defect found
If you notice a defect covered by the warranty:

Contact us by email at hello@stonology.fr by providing:

A clear photo of the jewelry showing the defect,

The purchase invoice,

A description of the problem.

After studying the file, Stonology will confirm by email whether the defect is covered by the warranty and will inform you of the return or repair procedures.
The return address will be communicated in this email.
The customer must keep proof of shipment (e.g. tracking, insurance). The costs and risks associated with transport remain the responsibility of the customer.
14.3 Cases not covered by the warranty
The warranty does not cover the following cases:

Deformations or damage caused by snagging, misuse, accident, carelessness or normal wear and tear,

Damage related to the use of chemical products (perfume, lotions, household products),
-
Damage due to failure to follow maintenance instructions,
-
Interventions by a third party.
In these cases, or if the warranty has expired, Stonology offers a paid repair service.
14.4 Indicative prices for out-of-warranty repairs

Mounting a simple necklace: 20 €

Mounting a necklace using the knot technique: 45 €

Assembly of a simple bracelet: 10 €

Assembling a bracelet using the knot technique: 22 €
These rates cover labor, excluding the addition of stones or primers (which must be provided). If an addition is necessary, a detailed quote will be sent and submitted for approval before any work is carried out.
14.5 Processing times
Repairs are processed within an average time of 2 to 3 weeks from receipt of the jewel.
14.6 Return costs
Return costs are the responsibility of the customer.

the bracelets
To measure your wrist size, we offer two methods:
- Measure it using a sewing tape measure
- Measure it with a string by making a mark then transferring the size of the string to a ruler
This measurement, which should be taken next to the bone, will allow you to choose the size of your bracelet.
- S corresponds to a wrist of 15 to 17 cm
- M corresponds to a wrist of 16.5 to 18.5 cm
- L corresponds to a wrist of 18 cm to 20 cm

the necklaces
Most necklaces are between 40 and 45 cm, the size is specified in the description of each necklace.
You can use the diagram below to determine where your necklace will end up when worn. However, we recommend using a tape measure to accurately measure the length of a necklace.
Since all our jewelry is made to order, don't hesitate to ask us for a custom length quote. This way, you can choose the length of your necklace based on your body shape and the style you're looking for.
